— A federal appeals court late Thursday suspended a ruling that mandated President Donald Trump to relinquish control of members of California’s National Guard back to the state.
Senior US District Judge Charles Breyer had determined that Trump unlawfully federalized thousands of members of California’s National Guard and must restore control of the troops to the state by midday Friday. However, the order from the 9th US Circuit Court of Appeals has temporarily halted that requirement.
Breyer’s ruling, nonetheless, represents a significant victory for Democratic Governor Gavin Newsom, who filed a lawsuit against Trump and Defense Secretary Pete Hegseth earlier this week after the president activated the troops into federal service in response to protests in the Los Angeles area regarding Trump’s stringent immigration policies.
“His actions were illegal – both exceeding the scope of his statutory authority and violating the Tenth Amendment to the United States Constitution. He must therefore return control of the California National Guard to the Governor of the State of California immediately,” the judge stated in his 36-page ruling.
Breyer, from the federal district court in San Francisco, indicated that Trump had not fulfilled any of the necessary criteria required to mobilize members of a state’s National Guard and that the president had not adhered to a procedural element of federal law that mandates presidents to issue an order “through the governor” when they intend to federalize state troops.
“Regardless of whether the Defendants provided Governor Newsom an opportunity to consult with them or consent to the federalization of California’s National Guard, they did not issue their orders through him, and thus failed to comply with” federal law, he wrote. The panel of three judges from the 9th Circuit – two appointed by Trump and one appointed by former President Joe Biden – announced that it will conduct a hearing on the matter on Tuesday.
Trump expressed gratitude to the federal appeals court on Friday morning.
